| Description | The present irrigation-water policy of South Africa is based on the Water Act (Act 54 of 1956) as amended, and in this paper the most important legal aspects relating to irrigation are briefly highlighted. The basis of allocation of irrigation water is covered and the concepts of private water and public water are explained. The paper then deals with the powers vested in the state as far as control over public water is concerned, and its application. The water rights of properties riparian to public streams are discussed and water apportionment within and outside Government-controlled areas is briefly highlighted with reference to the concepts of normal and surplus flow. Die huidige besproeiingswaterbeleid van Suid-Afrika is gegrond op die Waterwet (Wet 54 van 1956), soos gewysig, en in hierdie referaat word probeer om die beiangrikste aspekte van die Wet wat betrekking op besproeiing het, vlugtig uit te lig. Daar word ingegaan op die toekenningsbasis van besproeiingswater, en die begrippe privaatwater en openbare water word toegelig. Die magte wat die Waterwet aan die staat verleen vir die insteiling van staatsbeheer oor openbare water en die toepassing daarvan, word bespreek. Voorts word daar ingegaan op die waterregte van oewereiendomme vir besproeiing uit openbare strome. Die begrippe van normale stroming en surplusvloei wat onderliggend is aan die toekenningsbasis, word verduidelik, en die bepaling van waterregte binne en buite Staatswaterbeheergebiede word kortliks toegelig. | |
